Welcome to GooPlay (the “Platform”). You are reading the Terms and Conditions of Use(the “Terms”), which governs the relationship and serves as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform and our related websites, services, applications, products and contents (collectively, the “Services”).
These Terms are drafted in U.S. English. To the extent any translated version of this Agreement conflicts with the English text, the English version shall prevail and govern.
If any provision of these Terms conflicts with mandatory local laws in your country/region, such mandatory local laws shall prevail.

Summary
You need to read these terms and conditions, because every time you visit Gooplay and use or access Gooplay services, you need to confirm that you accept these Terms and agree to comply with them. Here are the main points just in case you need:
  (1) Gooplay is intended for users aged 13 and above. Users aged 13 to 17 must review these Terms with a parent or legal guardian, who shall supervise the minor’s use of the Platform. By allowing the minor to use the Services, the guardian acknowledges and accepts these Terms on the minor’s behalf and assumes full responsibility for their conduct. Users under 13 are strictly prohibited from registering or using Gooplay.
  (2) Gooplay shall not be liable for any Content you post, upload or share on the Platform. However, we reserve the right to remove non-compliant Content in accordance with these Terms.We will remove it if we find something you post is inappropriate or illegal.
  (3) If you are concerned about how your data is being used by Gooplay then please refer to our Privacy Policy, which explains how we treat your personal data and protect your privacy when you use Gooplay. By using Gooplay, you have to agree that we can use this kind of data in accordance with our Privacy Policy.
  (4) You will not use Gooplay to do anything illegal, misleading, malicious, pornographic or discriminatory.
  (5) You shall be responsible for the following actions, including but not limited to, (i) You intentionally bypass Gooplay's review and verification systems, use false personal information to register a Gooplay account and using other individual's bank account to withdraw money from your Gooplay account; (ii) You cannot use Gooplay to engage in illegal or criminal activities such as money laundering, bribery, terrorist financing or any other kinds. If Gooplay has detected such activities, Gooplay has the right to terminate or suspend your account, refuse your withdrawal request and report such behaviors to related authorities.

Gooplay provides a brand new way for teenagers to interact. At Gooplay, teenagers can find interesting souls and have different cultural experiences around the world.
The terms apply whenever you use Gooplay, whether or not you have chosen to register, so please read them carefully. By accessing, using, registering or receiving services offered on Gooplay (the "Services") you are accepting and agreeing to be bound by the Terms.
IF YOU DO NOT ACCEPT AND AGREE TO THE TERMS, THEN YOU MUST NOT ACCESS OR USE THE APP OR SITE.

1. Privacy
Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use Gooplay to share with others and how we collect and use your contents and information. We encourage you to read the Privacy Policy, and to use it to help you make informed decisions.
For users in Southeast Asian jurisdictions (including but not limited to Indonesia and Vietnam), we comply with local data localization laws and regulations, and store relevant personal data on servers located within the respective jurisdiction as required by applicable mandates.

2. Sharing Your Content and Information
You are able to post all kinds of things on Gooplay, including photographs, messages and other contents ("Content"). You own all of the contents and information you post on Gooplay,While there are some rules about what is acceptable, so when you are using Gooplay you may not post or send any Content which:
  1. Violates any applicable local, national, or international laws, regulations, or judicial orders; 
  2. Threatens national security, public safety, or social stability as defined by applicable laws; 
  3. Infringes upon the reputation, honor, or legal rights of heroes, martyrs, or public figures in violation of applicable laws; 
  4. Promotes terrorism, extremism, or incites terrorist, extremist, or violent acts; 
  5. Incites racial, ethnic, or religious hatred, discrimination, or conflict, or harms national/ethnic unity; 
  6. Violates official religious policies, promotes illegal cults, or superstitious content that disturbs public order; 
  7. Spreads false information, rumors, or disinformation that disrupts social order or harms individuals or the public; 
  8. Contains obscenity, pornography, gambling, graphic violence, terror, or content that abets illegal or criminal acts; 
  9. Defames, insults, or harasses others, or infringes personal reputation, privacy, portrait rights, or other legitimate rights; 
  10. Uses misleading or exaggerated headlines that severely misrepresent the actual content; 
  11. Sensationalizes scandals, disputes, or illegal misconduct to attract attention; 
  12. Contains inappropriate or malicious commentary on natural disasters, major accidents, or public emergencies; 
  13. Contains sexually suggestive, provocative, or indecent content that triggers inappropriate sexual associations; 
  14. Is graphic, horrifying, or excessively cruel, causing physical or psychological discomfort to viewers; 
  15. Incites discrimination against any group based on region, social class, race, gender, religion, or disability; 
  16. Promotes vulgar, indecent, or morally offensive content; 
  17. Induces minors to imitate unsafe, illegal, or immoral behavior, or forms harmful habits; 
  18. Exploits, endangers, or infringes the lawful rights and physical/mental health of minors; 
  19. Harms the healthy online ecosystem, platform order, or user experience; 
  20. Incites illegal assemblies, associations, protests, demonstrations, or gatherings that disrupt public order; 
  21. Conducts activities in the name of illegal non-governmental organizations; 
  22. Violates applicable laws and regulations governing internet information services, public order, and morality; 
  23. Violates any other prohibitions set forth in applicable laws, administrative regulations, or platform policies;
  24. Content that offends the Thai monarch, members of the royal family, and related symbols;
  25. Content that blasphemes against Islamic or Buddhist doctrines, deities, or holy sites, or violates local religious taboos.
We always appreciate your feedback and suggestions about Gooplay and we may use your feedback or suggestions without any obligation to compensate you (just as you have no obligation to offer them).
We reserve the right at any time and without prior notice, to remove or disable access to the content at our discretion for any reason or no reason. Some of the reasons we may remove or disable access to content may include finding the content objectionable, in violation of these Terms, or harmful to the Services or our users. So please take it seriously when you post or send content via Gooplay because you are responsible for it and bear all liability in relation to the content.
The above content rules also apply to all instant messages and in-game chat content transmitted or posted via the Platform.

3. Protecting Other People's Rights
We respect other people's rights and do our best to keep Gooplay safe and clean, and we expect you to do the same.
(1) You will not post contents or take any action on Gooplay that infringes on or violates someone else's rights or violates the law.
(2) We can remove any contents or information you post on Gooplay if we believe that it violates these terms or our policies.
(3) If we remove your content for the sake of infringing on someone else's copyright, and if you believe we remove it by mistake, then we will provide you with an opportunity to appeal.
(4) If you repeatedly infringe on intellectual property rights of other people, we will disable your account.
(5) You will not use our copyrights or trademarks or any confusingly similar marks without our permission.
(6) If you collect information from users, you will: obtain their consent, make it clear that it is you (not Gooplay) that is the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
(7) You will not use automated scripts to collect information from or interact with the Services; You will not post anyone's identification documents or sensitive financial information on Gooplay.
(8) You will not intimidate or harass another, or promote sexually explicit materials, violence or discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;

4. Registration and Account
Account Usage Rules
  (1) To use this app, you may register a Gooplay account via email or through the app store, and you may also log in as a guest. The Company reserves the right to adjust or modify the registration methods based on user needs and product requirements.
  (2) Ownership of Gooplay accounts resides with the Company. Upon registration, users obtain only a usage right limited to the initial registrant. The initial registrant shall not gift, lend, lease, transfer, sell, or otherwise permit non-registrants to use the account. Non-registrants shall not use accounts through inheritance, transfer, or any other means. 
  (3) Users are responsible for maintaining account and password security. Users bear legal liability for all activities under their accounts. You agree never to disclose credentials to third parties and must immediately notify the Company of suspected unauthorized account use. 
  (4) When registering via email, the system automatically assigns an uneditable Gooplay ID. 
  (5) Accounts inactive for extended periods may be reclaimed by the Company without liability. Resulting losses shall be borne solely by the user. 
To delete your account: Log in to GooPlay → Navigate to [Me] → [Settings] → [Delete Account] and follow the prompts. Account deletion is permanent and irreversible. We will process your deletion request in accordance with applicable data protection laws (e.g., the Personal Data Protection Act of respective jurisdictions).

Provision of information
Gooplay users are required to provide username, age, gender, profile photo and other optional information. Here are some commitments related to registering and maintaining the security of your account:
  1. You will not transfer your account to anyone without our permission.
  2. You will not provide any fake personal information on Gooplay, or create an account for anyone other than yourself without permission.
  3. If we disable your account, you will not post any content on Gooplay. You can contact the official assistant from "Gooplay Team" for help.
  4. We reserve the right to terminate or suspend your account if we believe it is appropriate.
  5. We may recommend your profile as "Featured User" to other users at our discretion.
  6. If you choose to use your social media account to sign up (such as Facebook, Instagram, and Google), we may collect information from these social media platforms, including your profile photo, username, gender, birthday, age, etc.

Termination
If you violate the Terms, then we reserve the right to give you notice or refund any unused services to:
  1. suspend or revoke your registration (where applicable) and your right to access and/or use Gooplay or submit any content to Gooplay.
  2. make use of any operational, technological, legal, or other means available to enforce the Terms (including without limitation blocking specific IP addresses).
We will try (but we are not obliged) to notify you if your access to Gooplay and/or your Profile is to be or has been suspended or terminated.
If you have registered on Gooplay, you can terminate your registration at any time by going to the "Settings" on Gooplay when you are logged in and choosing "Delete Account". Please understand that if you choose to delete an account on our platform, your account shall be permanently deleted from Gooplay. We have no obligation to save your information, including your profile information and the content you have posted. We may delete this information from our servers within the period permitted by the law on a periodic basis.
We will delete or anonymize your personal data and posted content from our active servers within the time period required by applicable laws. You may request information about the deletion status of your data as set forth in our Privacy Policy.

5. In-App Purchase and Subscription
From time to time, Gooplay may offer additional products and services for purchase through the App Store, Google Play or other application platforms ("in-app purchase"). If you choose to make an in-app purchase, you will be prompted to enter the mobile platform (e.g., Apple, Android, etc.) ("your IAP Account"), and your IAP Account will be charged for the in-app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in-app purchase that apply to your IAP Account. If you purchase an auto-recurring periodic subscription through an in-app purchase, your IAP Account will be billed continuously for the subscription until you cancel in accordance with the platform terms. In all cases, please refer to the terms of your application platform which applies to your in-app purchase.

Subscription Tips
(1) Subscription automatically renews unless the auto-renew is turned off at least 24 hours before the end of the current period;
(2) Accounts will be charged for renewal within 24 hours prior to the end of the current period;
(3) Subscriptions can be managed by the user: auto-renewal can be turned off by going to the user's Account Settings after purchase;
(4) You may manage your subscription and turn off auto-renewal through your platform account settings at any time, in accordance with the App Store, Google Play, or other applicable platform terms.

Virtual Currency
(1) GooPlay offers two types of virtual assets: GooPlay Diamonds (obtainable via in-app purchase) and GooPlay Coins (obtainable via daily check-in, gameplay rewards, or Diamonds conversion). Both Diamonds and Coins may be used for Game Rooms gameplay, room entry, interactive entertainment, unlocking casual content, and purchasing in-game items for GooPlay Mini-Games.
(2) You acknowledge that all transfers, redemptions, and uses of Diamonds and Coins are at your sole discretion, and all transactions are irrevocable and non-refundable once confirmed. Diamonds may be converted to Coins at an official rate set by GooPlay.
All virtual currencies and related items have no real-world monetary value, are non-transferable, non-resellable, non-exchangeable for cash, physical goods, or any third-party benefits, and may only be used for personal, non-commercial entertainment within the Service.
(3) The value (i.e. the exchange rate) of Diamonds and the Diamonds-to-Coins conversion rate are determined by Gooplay based on your country, and Gooplay further reserves the right to modify these rates from time to time, with or without reason, in its sole discretion. By your use of the Service, you confirm your understanding and accept the current rates at the time of your purchase or conversion. 
(4) Your use of any Diamonds or Coins purchased/converted shall be solely for legitimate purposes within the Service, and must comply with all applicable laws at all times (i.e. no exchanging of Diamonds/Coins for any activities, products, conduct or services deemed unauthorized by the Terms of Use or our Community Policy). 
(5) If your account is terminated by Gooplay, any Diamonds or Coins remaining in your account at the time of termination may be confiscated and will not be recoverable in Gooplay's sole and absolute discretion. 
(6) You understand that the purchase of Diamonds requires actual money. Coins cannot be purchased directly with real currency and can be obtained through Diamonds conversion, daily check-in, or gameplay rewards (as specified in Section 5.1). If you disagree with any part of, or do not fully understand, our exchange rate policy, please refrain from purchasing Diamonds or converting to Coins.
(7) You understand that Gooplay may change, modify or update the Terms of Use, or the terms of sales in connection with Diamonds and Coins from time to time, and that such revised terms will apply to all subsequent purchases of Diamonds or conversions to Coins, and you agree that you will review these Terms of Use prior to making any purchase or conversion. 
(8) GooPlay Diamonds are virtual assets which can be obtained by online payments such as credit card/ debit card/ bank transfer/ wallet/ Google Payments/ iTunes Payments and so on; Coins are virtual in-game currency obtained through Diamonds conversion, daily check-in, or gameplay rewards (as specified in Section 5.1).
(9) Refunds and Chargebacks: in-app purchases of Gooplay Diamonds are subject to the refund policies of the Apple App Store, Google Play Store, and applicable local consumer protection laws. You may submit a refund request in accordance with the rules of the relevant application distribution platform. Gooplay will only deny refunds or take account action as expressly permitted by platform rules and applicable law. Unauthorized chargebacks or fraudulent payment disputes may result in account suspension or termination in compliance with platform policies. Coins obtained through Diamonds conversion are non-refundable and non-reversible once converted, except where required by the refund policies of the App Store/Google Play Store or applicable consumer protection laws.
(10) Gooplay Diamonds and Coins are for in-Service use only. Private exchange between Diamonds/Coins and legal tender, offline trading, or transfer for non-platform purposes is strictly prohibited.

Minor Streaming and Virtual Currency Restrictions
Live streaming and audio chat room tipping services are unavailable on GooPlay. Minors may purchase, convert, or spend Diamonds and Coins (including Game Rooms usage) only with the explicit consent and in-person supervision of a parent or legal guardian. We implement age verification, purchase limits, and anti-addiction controls in compliance with regional laws and platform policies.

Illegal Profit
Users who obtain illegal profits via Gooplay shall bear full legal responsibility. Gooplay reserves the right to deduct all illegally obtained diamonds and associated benefits. In serious cases, Gooplay will pursue legal liabilities against such users in accordance with local laws of the relevant Southeast Asian jurisdiction.

6. Advertising/Promotions
Some of the Gooplay services are supported by advertising revenue and may display advertisements and promotions, and you hereby agree that Gooplay may place such advertising and promotions on the Gooplay services or on, about, or in conjunction with your content. The manner, mode and extent of such advertising and promotions are subject to changing without notice to you.

7. Abuse/Complaints
You can report any abuse or complain about the contents on Gooplay. We provide "Block" and "Report" functions for users to help us keep Gooplay clean and safe. You can report a user directly by clicking the "Report" on their profile, or report violations in IM chats or Mini-Games via the in-interface "Report" button, and select the reason for the complaint.

8. Intellectual Property
(1) Gooplay does NOT claim any ownership rights in the text, files, photos, videos, sounds, musical works, works of authorship, applications, or any other materials (collectively, "The Content") that you post on or through the Gooplay Services. By displaying or publishing ("posting") any contents on or through the Gooplay Services, you hereby grant to Gooplay a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such contents, including without limitation distributing part or all of the sites in any media formats through any media channels (including, Google, YouTube, Facebook, Instagram, etc.), except the content not shared publicly ("private") will not be distributed outside the Gooplay Services.
(2) You represent and warrant that: (i) you own the Content posted by you on or through the Gooplay Services or have the right to grant the license set forth in this section, (ii) the post and use of your contents on or through the Gooplay Services does not violate the privacy rights, public interests, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the post of your contents on the site does not result in a breach of contract between you and a third party.
(3) As between you and Gooplay, all contents, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audios, videos, music and all the intellectual property rights related (the “Gooplay Content”), are either owned or licensed by Gooplay. Gooplay Content is protected by laws of copyright, trademark, patent, trade secret, and Gooplay owns and retains all rights to Gooplay Content and the Gooplay Services. Gooplay hereby grants you a limited, revocable, nonsublicensable license to reproduce and display the Gooplay Content (excluding any software code) solely for your personal use in connection with viewing the site and using the Gooplay Services.
(4) The Gooplay Services contain Content of Users and other Gooplay licenses. Except as provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Gooplay Services.
(5) Gooplay performs technical functions necessary to offer the Gooplay Services, including but not limited to transcoding and/or reformatting Content to allow its use throughout the Gooplay Services.
(6) Although the Site and other Gooplay Services are normally available, there will be occasions when the site or other Gooplay Services will be interrupted for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that are beyond the control of Gooplay. Also, although Gooplay will normally only delete Content that violates this Agreement, Gooplay reserves the right to delete any Content for any reason, without prior notice. Deleted contents may be stored by Gooplay in order to comply with certain legal obligations and is not retrievable without a valid court order. Consequently, Gooplay encourages you to maintain your own backup of your contents. In other words, Gooplay is not a backup service. Gooplay shall not be liable for any modification, suspension, termination or discontinuation of the Services, or the loss, deletion or corruption of any Content, except where such liability is mandatory under applicable law (e.g., due to gross negligence or willful misconduct).

9. DMCA Copyright Complaints
If you believe that content available on or through the Service infringes your copyright, you may submit a written notification to our designated Copyright Agent pursuant to the Digital Millennium Copyright Act (DMCA). 
Notifications should include: 
  1. Identification of the copyrighted work claimed to have been infringed;
  2. Identification of the material that is claimed to be infringing;
  3. Your contact information (address, telephone number, email); 
  4. A statement that you have a good faith belief that use of the material is not authorized; 
  5. A statement under penalty of perjury that the information in the notification is accurate;
  6. Your physical or electronic signature.

10. Disclaimer of warranties and limitation of liability
To the fullest extent permitted by law, Gooplay expressly excludes:
  1. All conditions, representations, warranties and other terms which might be implied by statute, common law or the law of equity; 
  2. Any liability incurred by you arising from use of Gooplay, its services or these terms and conditions, including without limitation for any claims, charges, demands, damages, liabilities, losses or expenses of whatever nature and howsoever direct, indirect, incidental, special, exemplary, punitive or consequential damages (including negligence, EXCEPT for direct damages caused by Gooplay’s gross negligence or willful misconduct), loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, wasted management or office time, breach of contract or claims of third parties or other losses of any kind or character, even if Gooplay has been advised of the possibility of such damages or losses, arising out of or in connection with the use of Gooplay. This limitation on liability applies to, but is not limited to, the transmission of any disabling device or virus that may infect your equipment, failure or mechanical or electrical equipment or communication lines, telephone or other interconnect problems (for example, you cannot access your internet service provider), unauthorized access, theft, bodily injury (other than caused by our negligence), property damage, operator errors, strikes or other labor problems or any act of god in connection with Gooplay including, without limitation, any liability for loss of revenue or income, loss of profits or contracts, loss of business, loss of anticipated savings, loss of goodwill, loss of data, wasted management or office time and any other loss or damage of any kind, however arising and whether caused by tort (including, but not limited to, negligence), breach of contract, even if foreseeable, whether arising directly or indirectly.

11. Indemnity
You agree to defend, indemnify and hold harmless Gooplay, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Gooplay Service; (ii) your violation of any term of the Terms of Service; (iii) your violation of any third party rights, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Status Submissions caused damage to a third party. This defense and indemnification obligation will survive the Terms of Service and your use of the Gooplay Service. We don't support or encourage illegal consumption of alcohol or tobacco.

12. Terminal Security Responsibilities
(1) You understand and agree that this software, like most internet applications, may be affected by various factors including but not limited to user behavior, network service quality, and social environment. It may also face security threats, including but not limited to:
Unauthorized use of your information for physical harassment;
Viruses, trojans, or other malware in third-party software/websites threatening your terminal device data security, thereby disrupting normal use of this software.
You shall enhance awareness of information security and personal data protection, including password safeguards, to mitigate potential losses.
(2) You are prohibited from creating, publishing, using, or distributing malicious programs designed to:
Steal Gooplay accounts;
Compromise others’ personal information or property.
(3) Maintaining software security and normal operation is a shared responsibility between the Company and you. The Company will implement necessary technical measures consistent with industry standards to protect your terminal device information and data security. However, you acknowledge and agree that the Company cannot provide absolute guarantees.
(4) Under no circumstances should you credulously follow online instructions involving:
Loan requests;
Password disclosure;
Property-related operations.
Verify the counterparty’s identity before conducting property-related actions, and regularly heed the Company’s anti-fraud advisories.
(5) We do not recommend using our services during high-risk activities (e.g., driving) where significant injury or accidents may occur. You agree to refrain from such use and acknowledge that any violation breaches these Terms. You further confirm that:
All risks arising from such use are solely yours;
We shall not be liable for damages of any nature resulting therefrom.

13. Amendments
We reserve the right to make changes to these terms and give you the opportunity to review and comment on the revised terms before continuing to use our services. We may provide notice on the website if we make changes to policies, guidelines or other terms referenced in or incorporated by this Statement.

14. Third-Party Software or Technologies
(1) The Software may incorporate third-party software or technologies (including, without limitation, open-source code and public domain code, collectively referred to as "Third-Party Components"). Such use has obtained lawful authorization.
(2) If Third-Party Components are utilized in the Software, the Company will present relevant agreements or documentation in compliance with applicable regulations or agreements. These may be provided through:
Annexes to this Agreement;
Specific folders within the Software installation package;
Open-source software repositories or dedicated pages.
Such documentation may be titled "Software License Agreement," "Authorization Agreement," "Open-Source License," or similar designations.
(3) All agreements or documentation referenced above in any form constitute integral parts of this Agreement and hold equal legal effect. You are obligated to comply with these requirements.
Failure to comply may result in legal actions, fines, or other sanctions initiated by the relevant third party or governmental authorities. The Company may be requested to provide assistance in such proceedings, and you shall bear sole legal liability.
(4) Any disputes arising from Third-Party Components incorporated in the Software shall be resolved exclusively by the respective third-party provider. The Company:
Shall not be held liable for such disputes;
Provides no customer support for Third-Party Components.
For technical assistance, contact the third-party provider directly.


15. Miscellaneous
(1) Your use of this Software and Services shall be deemed as your acceptance of and agreement to be bound by this Agreement. The Company reserves the right to amend the terms of this Agreement when necessary. You may review the relevant agreement terms in the latest version of the Software. Continued use of the Software after any such amendments constitutes your acceptance of the modified Agreement. Should you disagree with the modified terms, you must cease using the Software immediately.
(2) This Agreement is executed in the Hong Kong Special Administrative Region of the People's Republic of China.
(3) The formation, validity, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China (excluding conflict of laws provisions); provided that mandatory local laws of your residence shall apply to the extent required by local regulations.
(4) Any dispute or controversy arising between you and the Company shall first be resolved through good-faith negotiations. Should negotiations fail, you irrevocably agree to submit the dispute to the competent people's court in the jurisdiction of the Agreement’s execution venue (as stipulated in Section 15.2).
(5) Section headings herein are for convenience only and shall not affect the interpretation or construction of any provision.
(6) This Agreement may be provided in multiple language versions, including but not limited to Chinese and English.
(7) Should any provision of this Agreement be held invalid or unenforceable, the remaining provisions shall remain in full force and effect and binding upon both parties.
(8) You and the Company are independent entities. Under no circumstances shall this Agreement constitute any express or implied warranty or condition by the Company toward you. Neither party shall be deemed an agent, partner, joint venturer, or employee of the other.

17. Instant Messaging (IM) Services
Gooplay provides private one-on-one and group instant messaging (collectively, the “IM Services”) for users to communicate and interact. You agree to comply with all provisions in these Terms when using IM Services, and the following additional rules shall apply:
1. Permitted Use
You may use IM Services to send text, stickers, images, short voice clips and other non-harmful content to other users for legitimate social communication. All IM content shall comply with the content prohibitions set forth in Section 2 of these Terms.
2. Prohibited Conduct via IM
You shall not use IM Services to:
  (1) Send spam messages, chain messages, commercial advertisements, or promotional content without the recipient’s explicit consent;
  (2) Harass, stalk, bully, threaten, defame or abuse other users through private messages;
  (3) Solicit, collect or disclose other users’ private information, including phone numbers, home addresses, financial details, ID documents or sensitive personal data;
  (4) Arrange offline meetings, private transactions, money transfers or any offline activities that may pose safety risks;
  (5) Distribute pornographic, violent, terrorist, discriminatory, illegal or otherwise inappropriate content through private chats;
  (6) Use automated scripts, bots or third-party tools to send bulk messages or disrupt normal IM functions.
3. Message Data & Privacy
(1) IM content is stored and processed in accordance with our Privacy Policy and local data localization rules for Southeast Asian jurisdictions.
(2) We will only access, review or disclose IM content when required by law, to investigate reported violations, or to protect the safety and rights of users and the platform.
(3) Deleting a chat on your device only removes local records; server-side records will be retained as required by applicable laws and then anonymized or deleted.
4. Report & Enforcement
You may report abusive, harassing or illegal IM content via the “Report” button in the chat interface. We will review reports and take actions including warning, message deletion, IM function restriction, account suspension or termination, consistent with Section 7 of these Terms.
5. Function Control
We reserve the right to restrict, suspend or modify IM functions at our discretion, including limiting message frequency, disabling group chats or blocking suspicious accounts, to maintain platform security and user experience.
6. Game Rooms Rules
(1) Game Rooms are interactive spaces for users to play casual mini-games, team up, and conduct group chat for non-commercial entertainment only. No live streaming, tipping, or paid chat services are provided. 
(2) You may use Diamonds and Coins for Game Room entry, gameplay consumption, decorative items, and casual interactive props within Game Rooms. All virtual currency usage in Game Rooms shall comply with the Virtual Currency rules in Section 5. 
(3) You must not use Game Rooms to host gambling, fraud, illegal transactions, harassment, or any content that violates Section 2 of these Terms. 
(4) We reserve the right to close, restrict, or ban any Game Room and related user accounts that violate these Terms, without prior notice.

18. Casual Mini-Games Services
Gooplay offers light-hearted casual mini-games (the “Mini-Games”) for entertainment and social interaction. These rules govern all use of Mini-Games and are an integral part of these Terms:
1. Scope & Eligibility
(1) Mini-Games include puzzle, match-3, arcade, leisure and other light casual games accessible within the Platform.
(2) Users aged 13 and above may play Mini-Games; users aged 13–17 must be supervised by a parent or legal guardian. Users under 13 are strictly prohibited from accessing Mini-Games.
2. Fair Play & Prohibited Actions
You shall not:
  (1) Use cheats, hacks, mods, auto-clickers, bots, scripts or any third-party tools to alter game mechanics, gain unfair advantages or disrupt game services;
  (2) Manipulate game rankings, scores, rewards or leaderboards through fraudulent means;
  (3) Harass, troll or disrupt other players during game sessions or in-game chat;
  (4) Copy, reverse-engineer, decompile, disassemble or create derivative works of any Mini-Game code, assets or content;
  (5) Use Mini-Games for money laundering, gambling, fraud or any illegal commercial activities.
3. In-Game Virtual Items, Gooplay Diamonds and Coins
(1) Gooplay Diamonds may be converted to Gooplay Coins, which are exclusively used to purchase in-game casual virtual items (e.g., skins, props, level boosts, limited decorations) within Mini-Games. Such virtual items are for personal entertainment use only and confer no ownership rights. 
(2) Coins are bound to your Platform account and can be obtained through Diamonds conversion,gameplay rewards or daily check-in (as specified in Section 5). They follow the same rules as set forth in Section 5 (Virtual Currency), may not be sold, traded, transferred or exchanged for real currency offline, and cannot be converted back to Diamonds once exchanged.
(3) We may adjust, update or remove virtual items, game levels or event rewards for operational reasons, with prior in-app notice where practicable.
4. Minor Protection for Mini-Games
(1) Users under 18 are prohibited from using Mini-Games or Game Rooms for any commercial profit.
(2) Minors may only purchase in-game items or spend Diamonds with the prior consent and supervision of a parent or legal guardian.
(3) We implement age-appropriate playtime reminders and may restrict game access during late-night hours as required by local Southeast Asian laws.
5. Game Services & Liability
(1) We may perform temporary maintenance, updates or bug fixes for Mini-Games, and will try to provide advance notice. We are not liable for temporary service interruptions.
(2) Game progress, scores, virtual items and Diamond usage records are stored on our servers. We are not responsible for data loss caused by your device error, unauthorized account use or violation of these Terms.
(3) We reserve the right to reset fraudulent scores, revoke illegitimate rewards, restrict game access or terminate accounts for users who violate Mini-Games rules.
